What Is Texas SB 140?
Texas Senate Bill 140 (SB 140) is a new law regulating how automated systems or AI agents can be used to call Texas residents. The law is designed to ensure that Texans know when they’re speaking with AI and are given the option to speak with a human or opt out entirely.

Key Requirements Under SB 140
To legally use AI agents to call Texas residents, your calls must include:
1. Clear Disclosure
At the start of the call, your AI agent must disclose that it is not a live person.
Example:
“Hi, this is [Agent Name] an AI-powered assistant calling on behalf of [Company Name]…”
2. Option to Speak with a Human
At any time, the person must be able to opt out and be transferred to a live agent.

3. Consent to Continue
You must ask the person if it’s okay to proceed with the conversation using AI.

4. State Registration and Bond (For Cold Outreach)

- Register with the Texas Secretary of State
- Post a $25,000 security bond
